U.S. Patent No. 10,383,358 B2

Cannabis IP patent

U.S. Patent No. 10,383,358 B2 (‘358) issued on August 20, 2019, entitled ”Cannabinoid Containing Cannabis Extract Infused into Rolling Paper.”  It was issued to inventors Benjamin S. Kaplan of Scarsdale, New York, Tobias Paquet, of Davis California, and Jason Paul Negrette, of Pacifica, California.  The applicant/assignee is Digital Rarity, LLC, of New York, New York.

The specification discloses an improvement over existing art of making cannabis rolling paper, with the inclusion of cannabis infusion into the paper during the papermaking process.  The ‘358 claims are directed to a method for making paper comprising infusion of a cannabinoid into the paper, where the cannabis extract is added during pulping, forming, and/or sizing steps.

The Cooperative Patent Classification is A24D, cigars, cigarettes, tobacco smoke filters, mouthpieces for cigars or cigarettes, namely, paper for roll-your-own cigarettes (1/022); and D21H, pulp compositions, preparations thereof not covered by subclasses D21C or D21D, impregnating or coating of paper, namely, non-fibrous material added to pulp, characterized by its constitution with material of vegetable origin (17/02), and macromolecular organic compounds, e.g., cellulose (17/25), and non-fibrous material added to the pulp, characterized by its function, namely, characterized by function or properties in the paper (21/14), sizing or water-repelling agents (21/16), agents rendering paper porous, absorbent or bulky, e.g., surfactants (21/24), and colorants (21/28).

While not a groundbreaking patent based on cannabis science research, the ‘358 patent illustrates the novelty of an improvement over existing art, and the notion that the simplest of new ideas can receive a patent grant.  Cannabis patents still represent a huge growth area for patent procurement and development, as the legalized industry is still in its infancy throughout much of the country.  Please contact Yonaxis for more information or if you have any questions.
